Terms and Conditions of Service

1. Purpose and acceptance
These Terms and Conditions (hereinafter, "Terms") govern access to and use of the ORIA platform (hereinafter, "the Service" or "ORIA"), a digital loyalty portal aimed at hospitality businesses and local shops (hereinafter, "the Customer" or "the Business"), operated by Reinaldo José León Rivera, Tax ID 60464852Z, with address at Carrer de la Renaixença, 25, Horta-Guinardó, 08041 Barcelona (hereinafter, "ORIA" or "the Provider").
Registering on the platform, accepting the electronic sign-up process (click-through), and/or subscribing to any plan implies full and unconditional acceptance of these Terms, including Annex I (Data Processing Agreement - DPA).
2. Service description
ORIA offers a digital-loyalty SaaS platform that lets the Business create and manage recognition programs for its end customers through digital cards, redeemable stamps, notifications, and analytics.
The specific features of each plan are described at oria.ninja/precios and may be updated as the Service evolves.
3. Registration and account
3.1. To use ORIA, the Business must register providing truthful information about its identity and business.
3.2. The Business is responsible for the confidentiality of its credentials.
3.3. Customer service and support are provided exclusively by email at hello@oria.ninja. No phone support is provided.
4. Pricing, billing, and refund policy
4.1. Current prices are published at oria.ninja/precios and are expressed excluding VAT unless stated otherwise.
4.2. Billing is recurring (monthly or annual) and is processed automatically through Stripe.
4.3. Trial period: Includes a 30-day free trial from registration. After that period, automatic billing will begin unless canceled beforehand.
4.4. Cancellation and refunds: The Business may cancel its subscription at any time from its panel. Cancellation will stop future renewals. As a general rule, no refunds are given for periods already billed; however, in the event of serious technical incidents attributable to the Service that prevent its use for more than 72 consecutive hours, ORIA may, at its sole discretion, assess a pro-rata refund of the affected portion of the monthly period.
5. Business obligations
The Business agrees to:
- Use the Service in accordance with applicable law.
- Not use ORIA for fraudulent or deceptive purposes.
- Be solely responsible for any uploaded content (logos, images, offers).
- Honor in good faith the rewards promised to its end customers.
6. Availability and limitation of liability
6.1. ORIA will make technically reasonable efforts to maintain the Service's availability, but does not guarantee uninterrupted or error-free operation.
6.2. Exclusion of liability for service outages: ORIA is fully exempt from liability for economic losses, loss of profit, loss of revenue, data loss, or indirect damages arising from outages, interruptions, or temporary unavailability of the Service.
6.3. In any case, should a competent court determine any liability, ORIA's maximum total compensation to the Business will be limited to the amount actually paid by the Business to ORIA during the last month of subscription prior to the event giving rise to the damage.
7. Intellectual property
ORIA, its software, trademarks, and content are owned by Reinaldo José León Rivera. The Business retains ownership of the logos and content it uploads to the platform.
8. Data protection
Data processing is governed by the Privacy Policy and by Annex I (Data Processing Agreement - DPA) incorporated into these Terms.
9. Governing law and jurisdiction
These Terms are governed by Spanish law. The parties submit to the Courts and Tribunals of Barcelona.
Annex I — Data Processing Agreement (DPA)
(In accordance with Article 28 GDPR)
By accepting these Terms and Conditions during the platform sign-up process, the Business (Data Controller) and ORIA (Data Processor) formalize this Agreement:
- Purpose: ORIA will process the Business's end customers' personal data (stamps, visits, rewards, identifiers) solely to provide the contracted loyalty service.
- Instructions: ORIA will process data solely following the Business's instructions as expressed through the control panel's configuration.
- Data location: Data is stored on Amazon Web Services (AWS) infrastructure located in the European Union (eu-west-1 region, Ireland).
- Security: ORIA applies appropriate technical and organizational measures to ensure the security, confidentiality, and integrity of data.
- Sub-processors: The Business authorizes ORIA to use AWS (hosting) and Stripe (payment processing) as sub-processors.
- End of Service: Upon termination of the contractual relationship, ORIA will delete or return the Business's data within a maximum of 60 days, unless legally required to retain it.
